Acceptable Use Policy

Internal Use Only

Customer shall use NTC Software only for its own internal business operations. Use of NTC Software to manage information technology infrastructure for customers as a managed service provider or similar outside vendor will be deemed use for the internal business operations of a third party.

Trial and Evaluation Use

During any trial or evaluation term, Customer shall use NTC Software made available on a trial or evaluation basis only for the purpose of evaluating whether that NTC Software will meet Customer’s business needs and shall not use the NTC Software in a production environment. Customer shall not submit data about identified or identifiable individuals to trial or evaluation Software, or configure the Software to collect or otherwise process such data, beyond the minimum necessary for Customer Personnel to create any necessary accounts for testing with simulated or anonymized data.

Prohibited Uses

Customer shall not:

  • rent, resell, or otherwise make NTC Software available to third parties for their own business purposes;
  • infringe or misappropriate any third party’s intellectual property or other right using NTC Software;
  • breach any agreement by using NTC Software not in compliance with this Agreement;
  • break any applicable law by using NTC Software not in compliance with this Agreement;
  • furnish or configure NTC Software to collect data in any way that infringes, misuses, or misappropriates any Intellectual Property, breaks any law, or breaches any other agreement;
  • use NTC Software for any activity where failure of NTC Software could foreseeably result in death, bodily injury, or environmental damage;
  • furnish, solicit, or use NTC Software in any other way that results in Network to Code processing Highly Regulated Data;
  • modify, decompile, disassemble, or reverse engineer NTC Software;
  • use NTC Software to create or operate products or services in direct competition with Network to Code;
  • remove proprietary marks or confidentiality notices received from NTC Software;
  • strain the technical infrastructure of NTC Software with an unreasonable volume or rate of requests, or requests designed to impose an unreasonable load; or
  • perform penetration, performance, load, or other technical tests on NTC Software without the prior written permission of Network to Code.

AI Acceptable Use Compliance

If NTC Software incorporates the functionality of third-party artificial intelligence services, such as ChatGPT from OpenAI, Customer shall not use those functions of the NTC Software in any way in violation of the providers’ published usage policies, as they may be updated by the provider.

Definitions

Highly Regulated Data” means data subject to laws, regulations, or private industry standards that impose special requirements on the collection, storage, processing, or transmission of data about particular classes of people or particularly sensitive kinds of data about people, including but not limited to data subject to the Payment Card Industry Data Security Standard, Gramm-Leach-Bliley Act, Health Insurance Portability and Accountability Act, Children’s Online Privacy Protection Act, Fair Credit Reporting Act, and European Union General Data Protection Regulation rules about special categories of personal data. Data subject to laws that apply only because the data relates to specifically identifiable people, such as the general GDPR provisions for “personal data” or California Consumer Privacy Act provisions for “personal information” more generally, are not Highly Regulated Data.
